By creating an account, accessing, or using the services provided by Hire Industrial AI LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Description of Service

Hire Industrial AI provides a B2B software platform that uses Artificial Intelligence ("AI") to automate recruitment workflows, candidate screening, and communication for industrial companies (the "Service").

3. Telephony & SMS Compliance (Critical)

The Service includes features that allow you to send SMS messages and place voice calls to third parties (e.g., job candidates) via integration with providers like Twilio. By using these features, you explicitly agree to the following:

3.1 Consent (Opt-In):

You represent and warrant that you have obtained clear, written consent from all recipients before contacting them via our Service. You agree not to purchase, rent, or use third-party lists of phone numbers.

3.2 TCPA & 10DLC Compliance:

You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA), A2P 10DLC regulations, and all applicable laws regarding unsolicited communication.

3.3 Prohibited Content:

You will not use the Service to send messages related to:

• Sex, Hate speech, Alcohol, Firearms, Tobacco (SHAFT).
• High-risk financial services (loans, debt relief).
• Any illegal or fraudulent activity.

3.4 Indemnification:

You agree to fully indemnify and hold Hire Industrial AI LLC harmless from any fines, fees, or damages resulting from your violation of telephony laws or carrier regulations.

4. AI Disclaimer

4.1 No Guarantee of Accuracy:

Our Service uses generative AI technology which may occasionally produce incorrect, biased, or misleading information ("Hallucinations"). You acknowledge that you should verify all AI-generated summaries, emails, or screening results before taking action.

4.2 Not a Hiring Decision Maker:

The Service is a tool to assist your hiring process, not a replacement for human judgment. Hire Industrial AI is not an employment agency. We do not guarantee that any candidate will be hired or that any specific position will be filled.

5. Subscription & Billing

5.1 Fees:

You agree to pay the recurring subscription fees and any usage-based fees (e.g., per-minute or per-message costs for telephony) associated with your plan.

5.2 Payment Authorization:

You authorize us to charge your payment method on file automatically.

5.3 No Refunds:

Payments are non-refundable unless required by law. You may cancel your subscription at any time to prevent future charges.

6. User Conduct & Restrictions

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to transmit viruses, malware, or harmful code.
• Resell, white-label, or sublicense the Service without our express written permission.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIRE INDUSTRIAL AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
